ParticipantIt’s come to my attention, along with many others, that the oath of office within the Shivwits By-laws, Article, VI, which states:
“I____, do solemnly swear that I will support and defend the By-laws of the Shivwits Band, that I will carry out faithfully and impartially the duties of my office to the best of my abilities, that I will cooperate, promote, and protect the best interest of the Shivwits Band, in accordance with these By-laws. That I am in the office to serve the whole band, not individual interest, and act for the betterment of the band and not myself.
This oath is not being followed as intended by our ancestral predecessors!
It seems as if some of our Shivwits band council or those who are going to run for band council, haven’t read all of the Shivwits By-laws or the Paiute Indian Tribe of Utah’s Constitution, which are an integral part of being on the Shivwits band council and the Paiute Indian Tribe council.
Remember this when taking the oath of office,” That it is not to be disregarded, set aside, forgotten, or tarnished, but always inculcated in the heart and mind, while serving as an officer or council member of the Shivwits Band or the Tribes council, who are dealing with matters concerning the band and tribal members.
There have been many instances in which the Shivwits band council hasn’t followed the oath.
For example:
1) The building of the golf course on Shivwits’ land.
As a member, I was told by the Shivwits Band’s council that we would take a vote to build or not to build, This vote never happened.
What did happen is a survey was put out by the SBC, it showed 28 people were for the golf course,17 against, and those who didn’t fill out the survey, because it was biased, also those who filled the survey out but didn’t choose for or against.
Filling out a survey doesn’t constitute a vote or imply one, but still yet the Shivwits band council took it upon themselves to move forward with the golf course on their own beliefs not the band as a whole. This was against the Shivwits By-laws, Article VI. OATH OF OFFICE.
The Shivwits band council made this happen by coercion.
Coercion invalidates consent.
Consent must be freely and voluntarily given.
If someone is pressured, tricked, or forced into an action, that consent is considered legally invalid!
The survey by the Shivwits SBC was trickery.
The Shivwits band council is making resolutions and ordinances, which in turn affect the band members.
These resolutions and ordinances are being drawn up and passed, without the Shivwits Band members’ knowledge or input.
Article, VII, section 4, subsection D) Duty to report:
The chairperson shall report in the monthly general meeting as to the affairs of the Shivwits Band.the chairperson shall include in this report all matters within his or her knowledge that may interest or require the attention of the band members.
Article, VI,Annual meeting:Manner of review by the band;
The chairperson of the band council shall call a general meeting of the band Annually,at which time he or she shall report in detail,to the band what has been done in the past year and set forth the plans of the band council for the coming year.This shall be Freely Discussed by the members at the annual meeting, and the wishes of the band members may be expressed by resolution, which shall govern the future actions of the band council,to be carried into effect by appropriate ordinances.
This meeting shall be held annually during the second week of July.
All that is put forth is due impart of Article,VI,OATH OF OFFICE.
The opposite of OATH of office involves breaking that solemn promise,with key concepts being perjury,treachery,betrayal,or violating the trust of the office. Often leading to impeachment or renunciation,representing a conscious turning away from duty and honesty.its the act of swearing falsely,disloyalty,or failing to uphold the commitments made. Unlike the affirmation to support and defend.
1) Perjury/Falsifying an oath: Intentionally swearing to tell falsehood or violating the truth when bound by oath.
2) Betrayal/Treachery/:Acting disloyally,deceitfully or breaking faith with the bands By-laws,Constitution and band members as a whole.
3)Renunciation/Abandonment: Formally giving up or forsaking the obligation of the Oath of office.
4)Violation/Breach:Infringing upon or failing to observe the duties and responsibilities of the OATH of office.
5)Dishonesty/Deceit: Actions contrary to the truthfulness expected.
In essence, while an OATH is a sacred promise to uphold a role, it’s opposite is the conscious subversion or Abandonment of that role through trickery, deceit or disloyalty and treason. Failing to support those who depend on you,often leading to negative consequences in personal, professional and political affairs, including life.
I would like to have each council member to remember their oath of office when dealing with business,culture and all of us as Shivwits Paiutes. -

ParticipantNot only has person achieved being a council member, but the oath is to be held to a higher standard when working for the Shivwits band members.
